LEGAL AGREEMENT AND ACCEPTANCE OF TERMS
This document constitutes a legally binding electronic agreement between the user (“User”, “You”, “Your”) and Shree Kameshwari Edutech Pvt. Ltd., operating under the brand name Astro Keshav Panditt (hereinafter referred to as the “Company”, “Platform”, “We”, “Us”, or “Our”).
By accessing the website, registering, submitting personal information, initiating communication via website, WhatsApp, phone, or any other medium, booking consultations, making payments, purchasing products, or availing any service, you expressly confirm that you have read, understood, and agreed to be bound by these Terms & Conditions, along with all related policies including Privacy Policy, Refund Policy, Disclaimer, and any service-specific conditions communicated from time to time.
This agreement is executed in electronic form and shall be deemed valid under the Information Technology Act, 2000. Your continued usage of the Platform shall constitute free, informed, specific, and unconditional consent without coercion, undue influence, or misrepresentation.
NATURE, CHARACTER, AND LIMITATION OF SERVICES
The Platform provides astrology-based and spiritual services including but not limited to horoscope analysis, astrological consultations, predictions, spiritual guidance, mantra suggestions, ritual recommendations, vastu advisory, and sale of spiritually energized or consecrated products.
The User expressly acknowledges that all such services are:
- interpretative in nature
- based on traditional knowledge systems
- dependent on practitioner expertise
- influenced by multiple external and subjective variables
The User further acknowledges that astrology is not an exact science and that outcomes cannot be guaranteed or uniformly replicated.
The services are intended solely for general guidance, awareness, and spiritual perspective and shall not be treated as professional advice in medical, legal, financial, psychological, or any other regulated domain.
Faith-based service and non-measurable-outcome clause
The User acknowledges that astrology readings, puja, anushthan, homa, japa, sankalp-based rituals, consultations, and allied services offered through the Platform are faith-based, tradition-governed, and custom-performed services. Such services are rendered according to the relevant sampradaya, ritual discipline, priestly discretion, religious custom, timing requirements, and practical constraints of performance.
The Company does not represent or warrant any guaranteed, fixed, measurable, or objectively verifiable outcome from any astrology or ritual service, including without limitation any spiritual, emotional, medical, legal, financial, relational, educational, career, marriage, fertility, property, litigation, health, planetary, or remedial result. Any description of benefits, significance, or spiritual purpose is devotional or informational in nature and shall not be construed as a promise of result.
The User further agrees that the service shall be deemed to have commenced once the Company records one or more of the following events: booking confirmation; allocation of priest, consultant, or ritual slot; preparation of sankalp particulars; scheduling according to muhurat or ritual availability; procurement or allocation of ritual materials; or actual initiation/performance of the ritual or consultation. Once commenced, the service is non-cancellable and non-refundable except in the event of duplicate payment, failed transaction, non-performance caused solely by the Company, or a refund that is mandatory under applicable law or a binding payment-system reversal.
The User agrees that any dispute or chargeback raised after service commencement may be defended by the Company through production of booking records, communications, acceptance logs, payment records, service-performance records, ritual/consultation evidence, and other electronic records maintained in the ordinary course of business.
NO GUARANTEE / NO MEASURABLE OUTCOME
The user expressly understands and agrees that all services provided by the Company, including astrological predictions, consultations, remedies, rituals, and spiritual products, are advisory and interpretative in nature and do not guarantee any specific result, outcome, or benefit.
The Company makes no representation or warranty, express or implied, regarding accuracy of predictions, timing of events, success of remedies, or improvement in any personal, financial, professional, relational, or health-related matter. Outcomes associated with astrology and spiritual practices are not measurable or verifiable in objective terms and therefore cannot be evaluated against any fixed standard or expectation.
Any expectation of specific results shall be deemed as a personal assumption of the user, and the Company shall not be liable for failure to achieve such expectations. Non-occurrence, delay, or variation in expected outcomes shall not constitute a valid ground for refund, dispute, or legal action.
USER RESPONSIBILITY AND DATA ACCURACY
The Company relies entirely on the information submitted by the user including but not limited to name, date of birth, time of birth, place of birth, and any other personal or situational data. The user expressly warrants that all such information is true, accurate, and complete.
The user acknowledges that even a minor deviation, particularly in time of birth, may result in a materially different horoscope and significantly affect the accuracy of predictions. The Company does not independently verify such data and shall not be liable for any inaccuracies in analysis arising from incorrect or incomplete information submitted by the user.
Any misuse of identity, submission of false data, impersonation, or concealment of relevant information shall constitute a breach of these Terms and may result in immediate termination of services without refund.
CONSULTATION, BOOKING AND SERVICE COMMENCEMENT
A booking made through the website or any associated communication channel shall be treated as an offer by the user, and acceptance of such offer shall occur only upon confirmation by the Company through scheduling, allocation of astrologer time, or initiation of preparatory work.
Consultations may be conducted via phone, video, in-person, or digital communication platforms depending on the nature of service. The duration, format, and scope of consultation shall be strictly as per the selected service.
Consultations are strictly time-bound. In case of delay due to the user, including late joining or unavailability, the Company shall not be obligated to extend the session. If the user fails to attend or respond at the scheduled time, the consultation shall be deemed completed without any obligation of rescheduling or refund.
RITUALS, PUJA AND ANUSHTHAN SERVICES (FINAL MERGED CLAUSE)
The user expressly acknowledges and agrees that all rituals, puja, and anushthan services offered through the platform are conducted strictly in accordance with established religious, spiritual, and customary practices, which inherently restrict, limit, or prohibit live recording, broadcasting, or real-time streaming during the performance of such rituals. Accordingly, the Company does not provide, and shall not be obligated to provide, any form of live video access, live streaming, or real-time participation in the ritual process.
The user further agrees that such rituals are performed by qualified and authorized priests or practitioners on behalf of the yajman (user), and the methodology, process, and execution of the ritual shall remain entirely within the discretion of the Company and the officiating practitioners, in accordance with traditional norms and religious sanctity requirements. The user shall have no right to interfere with, dictate, or demand alteration in the manner of performance of such rituals.
Where deemed appropriate, the Company may, at its sole discretion and without any obligation, provide a post-completion video, photographic evidence, or summary of the ritual for informational purposes only. Non-provision, delay, or inability to provide such material shall not constitute deficiency of service.
The user explicitly agrees that non-availability of live viewing, inability to attend, technical limitations, or dissatisfaction arising from absence of real-time access shall not be considered a valid ground for dispute, refund, or claim of deficiency in service.
For the purposes of this Agreement, the service shall be deemed as fully rendered and completed upon initiation or performance of the ritual by the Company or its authorized representatives, irrespective of whether the user has viewed, received, or acknowledged any post-completion material.
COMMUNICATION CONSENT AND RECORDING
By using the platform, the user expressly consents to receive communication through phone calls, SMS, WhatsApp, email, or other digital means, even if registered under any Do Not Disturb registry. Such communication may be recorded, stored, and used for service delivery, quality control, dispute resolution, fraud prevention, and legal compliance.
PRODUCTS AND SHIPPING
The website may offer spiritual products such as energized items, yantras, malas, or ritual materials. Such products may vary in appearance due to their handcrafted, spiritual, or ritualistic nature.
All products once dispatched are not eligible for return or refund unless proven defective at the time of delivery. Products that are energized, customized, or ritual-specific are strictly non-returnable under any circumstances.
PAYMENTS AND CHARGEBACK PROTECTION
All payments made are voluntary, informed, and for services clearly described on the platform. The Company does not store sensitive financial information and relies on third-party payment gateways.
The user agrees not to initiate any unjustified chargeback or payment dispute after availing services. In case of wrongful chargeback, the Company reserves the right to recover the amount along with legal costs, suspend services, and initiate legal proceedings.
REFUND AND CANCELLATION POLICY
Due to the personalized, interpretative, and faith-based nature of services, once a service has been booked, assigned, initiated, scheduled, or delivered, it shall be deemed accepted and non-refundable under all circumstances.
Refund requests shall not be entertained in cases of incorrect data submission, user absence, dissatisfaction with advice, unmet expectations, or misunderstanding of services. Refunds may only be considered in exceptional cases such as duplicate payment or failure of service solely attributable to the Company, and such decision shall be final and binding.
SPIRITUAL ADVISORY DISCLAIMER
All guidance provided is strictly spiritual and advisory in nature and shall not be treated as professional advice in any domain including medical, legal, financial, or psychological matters. The user agrees to seek independent professional advice before making decisions in such areas.
USER EXPECTATION WAIVER
The user acknowledges that no assurance, guarantee, or promise of outcome has been made. Any expectation of specific results is solely the user’s assumption and is not binding upon the Company. The user expressly waives any right to claim deficiency of service based on unmet expectations.
LIMITATION OF LIABILITY
The Company shall not be liable for any direct or indirect loss, including financial loss, emotional distress, or personal consequences arising from the use of services. The maximum liability, if any, shall be limited to the amount paid for the specific service.
FORCE MAJEURE
The Company shall not be liable for any delay or failure in performance due to circumstances beyond its control including natural events, religious restrictions, technical failures, or external disruptions.
TERMINATION AND SUSPENSION
The Company reserves the right to suspend or terminate access without notice in case of violation of terms, misuse of services, or unlawful activity. No refund shall be provided in such cases.
GOVERNING LAW AND JURISDICTION
This Agreement shall be governed by the laws of India. All disputes shall be subject exclusively to the jurisdiction of courts located in New Delhi.
